DEFINTIONS

“The Company” shall mean Concreations Limited registered In England under Number 6029557

“The Client” shall mean any person or Company who has ordered The Product from The Company

“The Product” shall mean any concrete or cement based goods ordered by The Client and provided by The Company

Trading terms

PAYMENT

Payment terms for The Product requires a 60% non-returnable deposit at the time of order. Final payment of the remaining 40% is to be made and cleared on or prior to the date of delivery. The Product remains the property of the Company until full and cleared payment has been made to The Company and The Product has been signed for prior to unloading on delivery. Payment in cash is possible with prior agreement.

Once production has commenced any alterations required / delays caused by The Client will be chargeable to The Client. (delay charges as below).

Delays in starting or cancellation of the project after the agreed commencement date or once production has begun may result in loss of deposit, loss of production schedule slot and/or additional daily delay fee of £500+Vat per day. Ordered or used materials will be charged to the client (+15%) once ordered or once production has begun.

Staggered production may begin, at The Companies discretion, once deposit payment has been made and/or purchase order (or equivalent email) supplied.

ESTIMATES

Estimates and quotations provided by The Company remain valid for 30 days. Waste water products for bespoke sinks / basins are priced assuming the use of conventional, non-specific outlets and excludes an overflow.


PROJECT DURATION

All estimated production times are based on scheduled start dates. Start dates can only be scheduled once the deposit has been paid and cleared and only after all the required dimensions and The Product specifications have been agreed in writing between The client and The Company. The scheduled start date will be used to calculate the expected completion date. Any delays outside the control of the Company may result in alterations to the scheduled completion date. (Production times average 4-8 weeks).


DAMAGE TO THE PRODUCT

It is the Client’s responsibility to fully inspect The Product prior to unloading and signing for their receipt. Any damage to The Product must be indicated to the driver/courier prior to unloading. The Company must be made aware of any issues relating to The Product immediately. Once delivered to curbside and signed for, the Client is responsible for The Product unless otherwise agreed in writing with the Company. Any damage caused to The Product once delivered is entirely the Client’s responsibility.
In the unlikely event that The Product is damaged in transit prior to The Client accepting delivery it will be replaced as quickly as possible. Replacement of damaged Product will require at least the same manufacturing lead time as applied to the original order. The Company accepts no liability for direct or indirect losses, costs or penalties resulting from delayed deliveries or delays caused by the replacement of damaged Product.
Where The Client has requested the services of The Company to fit The Product, The Company will be responsible only for their own actions and labour. Where part or all of the labour is provided by The Client, liability for any damage remains with The Client.
Any damage or injury caused directly or indirectly to property or individuals once The Product has been delivered and been signed for is entirely the Client’s responsibility unless agreed in writing prior to delivery.


Proceedures

SITE ACCESS – TEMPLATING, DELIVERY & FITTING

Parking (or parking permits) to be provided by the Client on or close to site where required. Standard local parking or Congestion fees are to be met by the Client if applicable.


TEMPLATING (when required)

All surface areas in need of templating should be cleared, have clear surrounding access, be of sound construction at the proposed final height of the surface prior to the Company’s arrival on site. Additional callout fees will be charged if additional trips to site are required.
It is the Client’s responsibility to ensure that all specific details such as size of overhangs, angles, positions of knock-outs for hobs, sinks, taps etc. are clearly understood by The Client or The Client’s representative on site and are reflected in the position and construction of units/carcasses on site. Manufacturer’s templates or specific dimensions of consumables, for all knock-outs are to be provided at the time of templating. The provision of accurate drawings prior to templating is highly recommended.
Subject to the product size and fitting logistics, the client may be required to provide unskilled labour to assist.
Duration for templating varies according to the project, it is the Clients responsibility to ensure the site remains open until templating is completed.


DELIVERY

Delivery dates and times will be adhered to wherever possible but cannot be guaranteed and do not constitute a contract between the Client and the Company. Curbside delivery with one driver is standard.
The Client must provide sufficient labour to unload goods. Standard projects require a minimum of 3-4 strong people (Please ask for recommendations in relation to your project). Unless agreed otherwise in writing, the Client is solely responsible for the handling from curbside to fitting location.
Unloading (and loading) of The Product at the delivery address should be completed by The Client in good time, normally within 45 minutes of arrival. The Company reserves the right to charge a waiting fee of not more than £30 per half hour applicable at the beginning of each half hour after 45 minutes has elapsed from the time of arrival at the delivery address.
If for any reason The Product is not unloaded within 2 hours of arrival at the delivery address, it will be returned to The Company’s premises. Where this was not the fault of The Company, an additional transportation charge of not more than 20% of the original total order invoice price will apply. The Company reserves the right to charge storage at a rate of not more that 20% of the original total order invoice price for every seven day period of storage, commencing on the date of return. All additional fees are to be paid in full prior to redelivery. If, through no fault of The Company, The Product cannot be redelivered within 2 months of return, The Company reserves the right to dispose of The Product as it sees fit.


PRODUCT AND FITTING

Fitting is only available where specifically included in the contract and constitutes the positioning and securing of The Product to a suitable existing sub structure and making good the joints, with silicone, between concrete products, this does not include joints between concrete and other wall finishes or the fitting of fixtures and fittings to the concrete.
Fitting of wall panels other than splash backs is not provided without prior written agreement. All overhangs should be supported sufficiently to prevent deflection due to predicted loads. The Company provides no indication of safe maximum loads and recommend caution when in use. Subject to the product size and fitting logistics, the client may be required to provide unskilled labour to assist during fitting. Duration for fitting varies according to the project, it is The Clients responsibility to ensure the site remains open until fitting is completed.
All measurements indicated may be subject to variation +/-5mm. Fitting gaps of up to 5mm on all wall facing edges and joints is normal practice. Worksurface flatness deviations of +/-3mm per linear meter may occur in some situations. Wall panels may have variations in flatness +/-5mm per linear meter due to the nature of the material. Variations will vary subject to panel size, thickness, shape and material.
It is The Client’s responsibility to provide enough sub structure and fixing support for The Product (carcasses, wall fixings etc.) Guide information available on request. We recommend supporting structures be stable and strong enough so as to provide continuous contact support for the entire surface. All sub-structures should be prepared and cleared by The Client, have clear surrounding access, be of sound, suitable construction and be at the proposed final position of The Product. Alterations or additions to supporting structures are not the responsibility of The Company and should be completed prior to delivery/ fitting.
Once completed, it is the client’s responsibility (or a representative there of) to inspect and sign for the work as satisfactory and complete before the fitter leaves the fitting site. Further trips to site after fitting completion will be charged accordingly.


CARE AND APPEARANCE

Any sample provided by The Company is to be a guide only and is an example of a particular mix design containing specific ingredient quantities where possible, not a guarantee of the final appearance of The Product. Due to the nature of the material and to the manufacturing, curing and finishing processes each item produced by The Company will be unique and individual in appearance. Variations including, but not limited to, The Product appearance and colour, hair line crazing, hair line cracks, flecking, pitting, dappling and texture are considered to be part of the natural beauty of the material and are not seen as defects.
Every effort will be made by The Company to produce continuity for items of a single project or order however this cannot be Guaranteed. Slurry filling of voids is normal but is a matter of choice for the client. Newly installed concrete products are still curing and must be allowed to acclimatize to the environment. In order to allow this to happen it is important that the surface is not covered. While the surface can be used items should not be left on the surface for a number of days to allow the surface to breathe and internal moisture to evaporate evenly.
Signs of dulling or whitening should be wiped down with a clean damp cloth as they appear.
Topical sealers are applied to help prevent staining and liquid penetration by providing The Client sufficient time to clean away staining material. It is The Client’s responsibility to remain diligent in the removal of possible stain/etch causing or penetrating substances.
Water may leave dull and/or visible patches if allowed to dry on the surface. We recommend water is wiped away and not allowed to dry on the surface. The use of sealers to protect the surface does not constitute a guarantee that the surface will not stain/etch, scratch or allow liquids to penetrate.
External concrete is subjected to extremes of temperature and environmental conditions such that may render any sealers ineffective. External concrete may weather when exposed to the elements and impurities in the raw material may cause discolouration. External concrete may crack or spall due to extremes of temperature. We recommend a weather proof cover to protect the surface during freezing weather and when not in use. Sealers can be damaged and may need to be periodically re-applied, this is especially relevant to high use areas and products that are submerged e.g. basins, bath tubs, water features and other external products.
Concrete sinks, baths etc. may require additional sealer to help protect the concrete surface from water ingress. Topical sealers may be scratched and damaged more easily than the concrete as they are made from softer material. Topically sealed surfaces should be protected from scratching, impact and abrasives. Dissolved minerals in the water supply may alter the appearance of the concrete. The Product, unless specifically stated on the invoice, is not designed or built to be used structurally. We do not recommend standing on or overloading your product.
Concrete that may be exposed to high heat, or uneven heating is more prone to hairline cracking due to variations in thermal expansion. This is unavoidable and normal and is not considered to be a design fault or the fault of the The Company. Very high temperatures 150 + degrees should be avoided.


MEDIA and BRANDING

The Company reserves the right to photograph the finished Product in the finished environment for use in promotional media.
Where the Company’s work is to be featured in any media the Company is to be credited for the work.
The Company reserves the right to brand products with a Concreations Ltd Logo type on a visible surface.
